Common Executor Mistakes to Avoid

  • Distributing before debts and taxes are paid. An executor can be held personally liable for distributing assets before Pennsylvania inheritance tax, debts, and expenses are satisfied.
  • Missing the beneficiary notice requirement. Pennsylvania requires written notice to beneficiaries and heirs within 3 months of the grant of Letters, plus filing a certification that you gave it.
  • Paying bills from your own pocket. Estate debts are paid from the estate account, never your personal funds.
  • Missing the 9-month inheritance tax deadline. Late filing means interest and penalties — and paying within 3 months earns a 5% discount.
  • Distributing without written releases. Get signed receipts and releases from beneficiaries before final distribution to protect yourself.
