1. Approximate value of assets titled solely in the decedent's name Include bank accounts, brokerage accounts, vehicles, and personal property in the decedent's name only. Do not include joint accounts, accounts with named beneficiaries (POD/TOD), IRAs, or real estate.
2. Does the estate include Pennsylvania real estate titled in the decedent's name alone? Joint tenancy, tenancy by the entireties, and trust-owned real estate generally pass outside probate.
3. Did the decedent have a surviving spouse?
4. Who are the primary heirs or beneficiaries?
5. Are there significant outstanding debts or known creditor claims? Include medical bills, personal loans, credit cards, or potential Medicaid estate recovery claims.
6. Is the will being challenged, or are family disputes likely?
7. Are there bank or financial accounts with no named beneficiary and no joint owner?
