Common Trustee Mistakes to Avoid

  • Distributing before debts and taxes are paid. A trustee can be held personally liable for distributing assets before Pennsylvania inheritance tax, the grantor's debts, and administration expenses are satisfied.
  • Missing the beneficiary notice requirement. Pennsylvania law requires the trustee of an irrevocable trust to notify current beneficiaries — skipping this is a common and avoidable error.
  • Commingling trust funds with personal money. Trust assets must be kept separate, in an account under the trust's own tax ID.
  • Missing the 9-month inheritance tax deadline. Filing late means interest and penalties — and paying within 3 months earns a 5% discount.
  • Distributing without written releases. Get signed receipts and releases from beneficiaries before final distribution to protect yourself.
